What Rights Do Children Have To A Mother’s Life Insurance, If They Are Not The Beneficiary?

My father-in-law was the primary beneficiary in a life insurance policy for my mother-in-law. Since receiving the money, he uses it to buy drugs and drinks all the time. He also has a restraing order against him and two DUIs cases pending. Is there anything that his three children can do to get the money away from him?

    Nope. The money is his to do with as he pleases.

    Unfortunately, the money is his, no matter how he chooses to spend it.

    nothing to be done. life insurance is not like a will, it can’t be contested.
    with any luck, he won’t make it through all the money before he dies or goes to jail, in which case, his kids have a shot at it.

    If the life insurance policy stated him as the sole beneficiary, there is nothing you can do.
    Unfortunately, your father-in-law, although a criminal, is legally entitled to the money.
    The only way I see his children getting any of the money is to ensure, if possible, that they are now beneficiaries of his life insurance policy.

    A long shot, but check with the insurance company to see if there were any restrictions put on the inheritance, ie., certain amounts to be put into trusts for secondary beneficiaries, etc. Was there a will dated after the life insurance policy date? Did it saydifferent beneficiaries for that insurance? It may over ride the insurance policy.

    collect evidence and show it to the court… and engage a lawyer to prove why he’s not putting the money to good use…
