How Do I Find Out If I’m A Beneficiary On A Life Insurance Policy If His Widow Is Hiding The Papers Left To Me

Posted November 27, 2009 – 10:17 pm in: structured settlements FAQ

My grandfather died and left me a strong box full of legal papers. His widow had the key and half the papers are missing now. She is not blood related and seems to be giving everything to her kids and family. Claims she doesn’t know where they are. There was some life insurance policys and she also will not show me his last will and testament. How do I find out if I’m a beneficiary not knowing names of the insurance companies or the papers left to me?

Well, you can’t find out if you’re the beneficiary, unless you get a check in the mail. She can’t give the life policy to someone else – also, she can’t know for sure who the beneficiary is, until it’s too late – that means, until she’s filed the claim, and the check goes to the beneficiary.
A last will and testament needs to be filed with probate court in order to transfer property, like a car or house or bank account. So, go down to the local probate court, and see if it’s been filed. It becomes a matter of public record after it’s filed. If there’s no will, then the judge decides – but in most states, with no minor children, the spouse gets everything. In a state where the spouse has to share with children, in a judge’s ruling, grandchildren get nothing.
don’t assume your grandfather had life insurance in place, most people don’t. If he did, it’s reasonable to assume he left his wife as primary beneficiary, most people do.
It’s pretty darned rare to have a guy over 60 with life insurance, that DOESN’T leave it to his wife.
