If a person has a life insurance policy and dies, if they owe back child support does the child to whom the money is owed to get part of it?

The life insurance will go to beneficiary. However, many states have laws wherein the court will order a person owing child support to purchase life insurance and name the child as the irrevocable beneficiary. Many parents fail to ask for it even when they have attorneys, Additionally, a parent can bring a lawsuit against the estate of the person that owes child support in order to satisfy unpaid child support and future support.

It does go only to the beneficiary, however, a child’s mother could push for the estate to go into probate and then put a claim of the back child support against the estate.
That’s definitely a question for an estate/probate attorney.
